Liability and Disclaimer Policy
Draft, pending legal review
1. Purpose
This policy explains who is responsible when something goes wrong. It is part of the Terms of Use. Nothing in it limits or excludes liability that cannot be limited or excluded under Saudi law, including fraud, gross fault, death or personal injury, harm to third parties, and any rights you have as a consumer.
2. What FARAH is not responsible for
- (a) The event. The host organises the event. FARAH is not responsible for the venue, safety, hospitality, cost, cancellation, guests' conduct, attendance numbers, or the host's decisions about whom to admit or refuse.
- (b) Messages. FARAH does not send invitations. We are not responsible for WhatsApp delivery, delay, blocking or account restrictions.
- (c) Guest and host content. We do not review it and are not responsible for its accuracy, legality or for any statements about people in it.
- (d) Door check-in. QR scanning helps the host, but faults can occur (a damaged screen, a camera problem, no signal). Hosts should keep a backup copy of the guest list. Beyond restoring the service, we are not liable for a guest being delayed or turned away because of a scanner fault.
- (e) Third parties. We are not responsible for third-party networks, devices, browsers, maps, WhatsApp, or cloud outages outside our reasonable control.
3. Limits
3.1 Excluded losses. Subject to 3.4, neither party is liable to the other for loss of profit or revenue, loss of opportunity, loss of goodwill or reputation, or indirect or unforeseeable loss.
3.2 General cap. Subject to 3.3 and 3.4, each party's total liability under or in connection with the Terms in any 12-month period is limited to the greater of (a) the fees the host paid in the 12 months before the event giving rise to the claim, and (b) SAR 500.
3.3 Data protection cap. For breach of our data-protection or security obligations, each party's total liability is limited to two times the amount in 3.2(a) or SAR 2,000, whichever is greater. This replaces the general cap for those claims.
3.4 Not limited. Fraud; gross negligence; wilful misconduct; death or personal injury; harm to third parties that cannot be excluded in advance; the host's duty to pay fees due; any liability that cannot be limited by law.
3.5 Mitigation and shared fault. Each party must take reasonable steps to reduce loss. Where the host, their helpers or guests contributed to the loss, our liability reduces in proportion.
4. Data loss and security incidents
4.1 Where we keep backups, we keep them no longer than 35 days. If your content is lost because of our breach, we will use our best efforts to restore it from the latest backup, if one exists, at our cost. Hosts should keep their own copy of the guest list. You can download a copy of your data and close your account yourself in the app, under Account; closing deletes your events and guest data immediately (the uploaded invitation photo is deleted together with the event, and the old photo is deleted when you replace it). If you cannot use these tools, email us at [Privacy contact email - TO BE COMPLETED] and we will respond within 30 days.
4.2 Responsibility: we are responsible for our failure to apply our stated security measures; the host is responsible for a stolen or shared password, sharing invitation or helper links, and content they upload or send.
4.3 We will notify you without undue delay, aiming for within 24 hours after confirming a personal-data breach affecting your guests' data, with what you need to meet your own duty to notify SDAIA within 72 hours.
5. Claims
Please tell us in writing within 60 days of becoming aware of a problem, with details. This does not shorten any limitation period under Saudi law. We will try to resolve it before any court process.
6. Force majeure and exceptional circumstances
As in section 13 of the Terms of Use. Either party may ask a court to adjust the agreement in exceptional circumstances as Saudi law permits.
7. Changes and language
Changes follow section 14 of the Terms of Use. A change that reduces our liability does not apply to a period you have already paid for without your consent. Arabic prevails.
