Terms of Use
Draft, pending legal review
1. About these Terms
1.1 These Terms are between [Legal entity name - TO BE COMPLETED], CR No. [CR number - TO BE COMPLETED], [Registered address - TO BE COMPLETED] ("FARAH", "we") and you, the person or business creating an account ("Host", "you"). Guests who open an invitation are not parties, but our Privacy Policy explains how their data is treated.
1.2 These Terms include our Privacy Policy, Cookie Notice and Liability and Disclaimer Policy. If they conflict, these Terms prevail, except that a signed order form prevails over all.
1.3 By ticking the box at sign-up you agree to them. You confirm you are 18 or older and, if acting for a business, that you can bind it. We keep a record of your acceptance (date, version, IP address).
2. The service
FARAH lets you create an event with sub-events, design an invitation, add guests, generate a link for each guest to send from your own WhatsApp, collect RSVPs, review plus-one requests, and check guests in with QR codes. Features depend on your plan; plan limits (guests and events) are shown in the app.
3. Your account
Keep your login private. You are responsible for what happens under your account and for the helpers you add. Tell us promptly if you think it was misused. Give accurate information.
4. Guest information: your responsibilities
4.1 You enter guests' names and mobile numbers. You decide why and how they are used, and we process them on your instructions to provide the service. This section is our data-processing agreement with you.
4.2 You confirm you have a proper reason to hold and contact each guest (they are people you know or would reasonably expect to invite), and that you will not upload others' data you have no reason to have.
4.3 You will tell guests, if they ask, what you hold, and you will correct or delete their details on request. We will help. Guests can also remove their own details through their invitation page; when one does, you will see an anonymous placeholder, “Guest removed at their request”, in your guest list instead of their entry.
4.4 We will use guest data only to run FARAH for you, keep it secure, tell you without undue delay of any breach, help you answer guests' requests, delete it as in the Privacy Policy, and not use it for our own marketing. Our hosting provider, named in the Privacy Policy, acts as our sub-processor.
5. Messages and WhatsApp
FARAH does not send messages. You send each invitation from your own WhatsApp. You must follow WhatsApp's terms and Saudi anti-spam rules: no bulk or unsolicited promotional messaging, and stop contacting anyone who asks. We are not responsible for delivery, blocking or account action by WhatsApp.
6. Acceptable use
You will not use FARAH for anything unlawful; to harass, defraud, threaten or spread hatred or content that offends public order or morals; to invite people to unlawful gatherings; to upload malware; to scrape, attack or bypass limits; to test security without our written permission; to copy or reverse-engineer the software beyond what the law allows; or to collect data about children beyond a name given by a parent or guardian. We may remove content or suspend the account for breach (see section 10).
7. Your content
You own your event content and guest data. You give us permission to store, display and process it only to provide the service. You are responsible for photos, text and links you upload, including having the right to use them and to show any people in them.
8. Our commitments
We will provide the service with reasonable skill, apply the security measures in the Privacy Policy, and tell you of material changes. Where we keep backups, we keep them no longer than 35 days. The service is provided "as available": we aim for high availability but do not promise it will be uninterrupted. See the Liability and Disclaimer Policy.
9. Plans and payment
Plans, limits and prices in SAR (VAT extra where applicable) are shown in the app. Online payment is not in use at the moment; payment terms will be added here before it is. We do not charge late-payment interest. You can ask to downgrade or close your account at any time (see section 10), and any rights you have by law continue to apply.
10. Suspension and closing
You can download a copy of your data and close your account yourself in the app, under Account (Download my data and Close my account). Closing your account deletes your events and guest data immediately (the uploaded invitation photo is deleted together with the event, and the old photo is deleted when you replace it) and cannot be undone. A stub account record and the record of your acceptance of these Terms and the Privacy Policy are kept for 6 months to prove your consent, and are then deleted. If you cannot use these tools, email us at [Privacy contact email - TO BE COMPLETED] and we will respond within 30 days. You should keep your own copy of your guest list. We may suspend your account for a serious breach, security risk or legal order, giving notice where lawful and a chance to fix the problem where possible. After closing we keep only what the Privacy Policy states.
11. Confidentiality and intellectual property
We own the software, designs and FARAH name; you own your content. You may use our templates for your events. Feedback you give may be used to improve the service.
12. Liability
See the Liability and Disclaimer Policy. Nothing in these Terms limits liability that the law does not allow us to limit, including fraud and gross fault, or rights you have as a consumer.
13. Force majeure
Neither of us is liable for delay caused by events beyond reasonable control (for example government action, network or cloud outages, cyber attack despite reasonable security). This does not affect either party's right to ask a court to adjust the contract in exceptional circumstances.
14. Changes
We may update these Terms. We will tell you at least 30 days before a material change by email or in the app. If you do not agree you may close your account before it applies (see section 10). Changes are not retroactive.
15. Law and disputes
Saudi law applies. We will first try to resolve any dispute by talking. Disputes go to the competent courts in Riyadh. Arbitration may be used only if both parties agree to it.
16. General
Arabic and English versions are provided; Arabic prevails. Notices go by email and in-app. If part of these Terms is unenforceable the rest continues. These Terms and the documents in 1.2 are the whole agreement. Contact: [Legal entity name - TO BE COMPLETED], [Registered address - TO BE COMPLETED], [Privacy contact email - TO BE COMPLETED], CR No. [CR number - TO BE COMPLETED].
